Standard Spectrum Control Warranty

Products are warranted against defects in workmanship and materials for a period of one (1) year from the date of shipment.

Extended warranties are available, at time of contract negotiation terms may be defined per incremental 12-month period.

Spectrum Control Standard Warranty

Spectrum Control warrants the buyer that the products sold hereunder are free from defects in material and workmanship under normal use and service, subject to exceptions stated herein. Products purchased are warranted for the period, starting from the date of shipment to the original buyer, set forth, below. Notwithstanding the forgoing, those products Spectrum Control acquires from or through a third-party manufacturer or distributor and resells to the buyer as the original customer will carry the manufacturer’s pass-through warranty, if any, in accordance below. Since Spectrum Control’s responsibility ceases upon delivery of the products in good order to a carrier, any claims for damage or shortage in transit must be brought against the carrier.

Metal Oxide Varistors (MOV’s) are protection devices, which are intended to self-destruct in cases of extreme voltage spikes or surges, and repairs relative to these devices, are not covered under this warranty.

External physical damage (not shipping related) to any units NOT reported within thirty-days (30) of receipt of the product.

Shipping damage – Must be brought to the attention of Carrier immediately.

Test failure for tests not authorized by Spectrum Control are not covered under warranty. Spectrum Control, Inc. test procedures are available upon request.

Spectrum Control will honor the warranty at a Spectrum Control repair facility in the United States as specified by Spectrum Control, provided all procedures are followed. Purchaser will return unit(s) at its own expense and only with prior authorization from the factory. Instructions will be given by an authorized factory representative at the time an inquiry is made. Expedite delivery charges are to be paid by the customer.

EXCEPT FOR THE EXPRESS WARRANTIES STATED HEREIN, SPECTRUM CONTROL DESCLAIMS ALL WARRANTIES ON PRODUCTS FURNISHED HEREUNDER, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS; and the stated express warranties are in lieu of all obligations or liabilities connected with the performance of the products.

Warranty Claim Procedure

If any products purchased from Spectrum Control are defective under the above warranty, the buyer must so contact Spectrum Control promptly after receipt of the products. In order to return material to the manufacturer, a Return Material Authorization (RMA) number is required as well as a customer assigned purchase order number in order to cover the costs of the RMA.

Upon receipt, Spectrum Control, or it’s authorized or designated representative shall have the right to inspect the claimed defective product to confirm the existence of such a defect. If Spectrum Control determines the product was defective at the time of delivery, Spectrum Control shall repair or replace the defective product at its sole option and discretion and return the repaired or replacement product to the buyer with shipping charges prepaid to the buyer’s site. Claims for non-conforming orders will not be considered unless made in writing to Spectrum Control within ten-days (10) couriers’ delivery to customer site.

LIMITATIONS OF WARRANTY CORRECTION OF DEFECTS BY REPAIR OR REPLACEMENT SHALL CONSTITUTE THE EXCLUSIVE SOLE REMEDY FOR A BREACH OF THIS LIMITED WARRANTY, AND SPECTRUM CONTROL WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES OR PERSONAL INJURY OR FOR LOSSES, DAMAGES, OR EXPENSES DIRECTLY OR INDIRECTLY RESULTING FROM THE USE OF ITS PRODUCTS.

Spectrum Control assumes no warranty liability with respect to defects in its product caused by:

  1. Buyer’s modification of the product, except as described in Spectrum Control’s instruction manual, if applicable:
  2. Buyer’s attempt to repair the product beyond the removal of plug-in printed circuit boards, switch lamps, or fuses:
  3. Buyer’s negligent, accidental, or other improper use of the product:
  4. Buyer’s installation, operation, or maintenance of the product other than in a manner described in the instruction manual, if applicable.
  5. Buyer’s combination of Spectrum Control’s products with product(s) not supplied by Spectrum Control.

THE ABOVE WARRANTY SUPERSEDES AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AND ALL OTHER OBLIGATIONS OR LIABILITIES OF SPECTRUM CONTROL, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. No agent, distributor, or other party is authorized to make any warranties on behalf of Spectrum Control or to assume for Spectrum Control any other liability in connection with any of Spectrum Control’s products.
